Great news! We are excited to share that you can now use Jasper Art for commercial purposes!
Note: The AI image-generation landscape is new and exciting. It’s also rapidly changing, including legally. These terms and the licenses granted to you are not definitive and we will continue to update them from time to time.
FAQ
What's New?
You can use the images you create using Jasper Art for your personal use and for any commercial projects that include those images.
What types of commercial projects are permitted?
Right now, we don’t have any limitations on the types of commercial projects where you could use the images. You can reprint and sell the images as your imagination permits – in digital forms, on the internet, on your website or other sites, on t-shirts, on tote bags, on coffee mugs, you name it! – as long as you follow our terms and some basic rules.
What are those rules?
Jasper AI is happy for you to use the content you generate using Jasper Art as long as you follow some common sense ethical and legal uses of that content. These include: not violating any applicable law when using the images; not exploiting any minors; not sharing or creating verifiably false information; not sharing personally identifiable information; not defaming, disparaging, or harassing anyone; and not discriminating against anyone on any legally-protected basis. You can find out more and check out the details here.
What rights do I have to use the images that Jasper AI creates with my input?
By using Jasper AI, and as long as you follow the rules and these terms, you basically have unlimited permissions to use the images commercially. For more legalese, subject to these commercial terms and our Terms of Service, you have a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare, publicly display, publicly perform, distribute, and create derivative works based on those images.
Can I tell the world where my images came from?
ABSOLUTELY! We’d love it if you tag us @heyjasperai when you use our images. Even better, we’d love it if you encourage others to use Jasper Art. Example: “I made this image with AI tools from Jasper – you can create your own here: https://www.jasper.ai/art!"
Who else can use my images?
Since Jasper Art is publicly available for the Internet community, by default your images are publicly viewable and remixable. You grant Jasper Art and its customers the same permissions to use any images that Jasper Art generated with your input as Jasper Art grants you to use those images. In other words, you grant us and our other users a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare, publicly display, publicly perform, distribute, and create derivative works based on those images.
As of now, the US Copyright office has refused to grant copyright protections to AI generated images.
So I don’t have exclusive rights to my images?
Our community is about sharing, and the way our platform works is that any content generated by Jasper Art is free for anyone to use, as long as you follow these terms. And if one of our other users happened to use the exact same inputs and got identical or nearly-identical results, they can also use their resulting image for commercial purposes just like you can.
Do I need any other permissions?
If you plan to any of your images commercially, just be aware that you might still need to get other permissions to use the content the way you want. For example, if you create images of public figures like celebrities or politicians or even non-public figures like someone’s grandmother, and those people can be identified, those people have certain publicity rights that we don’t own and can’t give you permission to exploit. So if you want to use any image that includes an identifiable person, logo, or character for any commercial purposes, we recommend that you get permission first.
What about biases in the images that are generated?
If used incorrectly, Artificial intelligence can create images that reinforce stereotypes, under represent groups and are otherwise biased. We are always striving to improve the model to help mitigate societal biases, but it needs human intervention, judgment and compassion in the inputs and review of images generated. We ask you as a user to do your part to minimize bias.
So I have a license. Could someone still challenge my right to use the images?
Depending on the inputs you include, the final image generated could look a lot like someone else’s painting, photograph, or other work of art – even if it’s not exact and is generated by our AI framework. But it might make some copyright owners or other rights holders concerned, and they could still contact you asking you to take down your image.
What else should I know before I use any images commercially?
Any use, including any commercial use, of the images generated by Jasper Art is at your own risk. To the maximum extent possible as permitted by applicable law, Jasper Art is provided with out warranties of any kind. Jasper Art does not warrant, endorse guarantee, or assume responsibility for any uses of the images that are generated. You agree to defend, indemnify, and hold harmless Jasper Art from any and all uses of the images that you generate.
